Buying a home in Vadodara as an NRI

A Non-Resident Indian or an Overseas Citizen of India can buy a house in Vadodara without the Reserve Bank's permission, paying from an NRE, NRO or FCNR account or by remittance from abroad. Indian banks lend to NRIs. A family member can act for you under a power of attorney, and you can see the site on a video call.

Many families who buy in Vadodara have a son, daughter or sibling abroad who is paying for the house, or buying it for parents. This page sets out the rules as they stand, with sources, and how we work with buyers who cannot be here.

What does the law allow?

Under India's foreign exchange law (FEMA) and the Reserve Bank's rules, an NRI or an OCI cardholder may buy any immovable property in India other than agricultural land, a plantation or a farmhouse. No permission from the Reserve Bank is needed for a residential house.

There is no limit on the number of homes you may buy. The limit that matters comes later: when you sell, the sale proceeds of at most two residential properties can be sent back abroad under the repatriation rules.

A person of Indian origin who holds neither an Indian passport nor an OCI card falls under different rules. Ask a chartered accountant before you commit.

How do you pay?

  • From abroad, by remittance through normal banking channels into India.
  • From your accounts in India: an NRE, FCNR(B) or NRO account.
  • Not in cash or travellers' cheques. Payment in foreign currency notes or travellers' cheques is not allowed.

Pay the developer by bank transfer from your own account, and keep every bank advice. You will need them when you sell and want to send the money back abroad: repatriation from an NRO account is capped at USD 1 million in a financial year.

Can you get a home loan from India while living abroad?

Yes. Under the Reserve Bank's directions, banks and registered housing finance companies may lend to NRIs for a home in India on the same terms as to residents, secured by a mortgage of the property. The EMIs can be paid by remittance from abroad, from your NRE, FCNR or NRO account, from rent on the property, or by a close relative in India.

The loan is limited to a share of the property's value: up to 90% for loans up to ₹30 lakh, up to 80% from ₹30 lakh to ₹75 lakh, and up to 75% above that. Stamp duty and registration are not counted in that value, so you pay them yourself.

Banks usually ask an NRI for a passport and visa or OCI card, proof of overseas address and income, a PAN, and bank statements. The home loan guide covers the EMI arithmetic.

Is TDS deducted when you buy?

From 1 April 2026 India's new Income-tax Act, 2025 is in force. When the price of a property is ₹50 lakh or more, the buyer must deduct tax at source of 1% of the higher of the price and the stamp duty value, and pay it to the government. This rule was section 194-IA of the old Act and is now section 393(1) of the new one.

As the buyer you need only your PAN. The deduction is reported on Form 141, which replaced Form 26QB, within 30 days of the end of the month in which you paid. Whether it applies to you depends on the price of the plot you choose; we will tell you when we give you the price.

When you later sell as an NRI, it works differently: your buyer must deduct tax under section 393(2) at the capital gains rate on the whole price, and needs a TAN to do so. You can apply for a lower-deduction certificate. Plan this with a chartered accountant before you sell, not after.

Can a family member sign for you?

Yes, under a power of attorney. Make it specific: name the property, and say exactly what your attorney may do (sign the agreement, pay, register the sale deed, take possession).

  1. Sign the power of attorney abroad before an Indian embassy or consulate, or before a local notary and then have it apostilled if the country is in the Hague Convention.
  2. Send the original to India.
  3. Within three months of its arrival in Gujarat, have it stamped (adjudicated) under the Gujarat Stamp Act. After that it can be impounded with a penalty.
  4. Your attorney then signs and registers in Vadodara on your behalf, with the original power of attorney and their own identity proof.

A power of attorney that also authorises a sale attracts higher stamp duty. Ask your advocate to draft it for this purchase only.

What is the house?

Lake Tree Avenue is a gated campus of 48 two-storey 2 BHK townhouses on Waghodia Main Road, Kamlapura, Vadodara, each on its own plot of 703 to 1,050 sq ft, with three bathrooms, its own terrace and parking at the door. Completion and possession are proposed for December 2028.

Many NRI buyers are buying for parents. Before you choose, read what the homes page says plainly: both bedrooms are upstairs, and there is no lift.
